These terms of service constitute a legally binding agreement (the “Agreement”) between you (“you,” or “your”) and Loans Connect LTD herein referred to as Instant Ride. (“Instant Ride,” “we,” “us” or “our”), a company registered in whales England , governing your use of the Instant Ride application, website, and technology platform (collectively, the “Instant Ride Platform”)
The Instant Ride Platform provides a marketplace where persons who seek transportation to certain destinations (“Riders”) can be matched with persons driving to or through those destinations (“Drivers”). Drivers and Riders are collectively referred to herein as “Users” and each User shall create a User account that enables such User to access the Instant Ride Platform. For purposes of this Agreement, the driving services provided by Drivers to Riders that are matched through the Platform shall be referred to collectively as the “Services”.
Instant Ride is not a transportation company nor does it own any vehicles. The service is based on the following service. The driver will have a choice to accept ride request via the platform from the Rider. The Rider shall also in the same manner accept a ride from the driver via the Instant Ride platform. These decisions made between the driver and ride is left at their sole discretion. The system merely matches a driver and rider. Each transaction, or and transportation services provided by the driver to a rider shall constitute a separate agreements between such parties.
By using the Instant Ride platform you agree to our terms and conditions as set out here and you further agree that your are bound to such terms and conditions. If you are not in agreement to the terms and conditions or any other policy that is set out by Instant Ride ,you may not use the Instant Ride platform. Instant Ride may at its own discretion may terminate or deny services or access to Instant Ride platform

Instant Ride platform is a marketplace where a Driver is matched with a Rider based on the location of the said parties. You agree does not provide transportation services or function as such carrier and all transportation services are performed by third party independent contractors who are not employed by Instant Ride or any of its subsidiaries/affiliates.
The Instant Ride platform is available only to, and may only be used by individuals who can form legally binding contracts under applicable law. By becoming a User, you represent and warrant that you are at least 18 years old and that you have the right, authority and capacity to enter into and abide by the terms and conditions of this Agreement.
You may not reproduce any part of Instant Ride platform in any form of its intellectual property. At all times Instant Ride platform will belong to Instant Ride, These terms or the use of Instant Ride platform will not grant you any right.
The Instant Ride platform may be accessed via third party services that Instant Ride does not control. Instant Ride does not endorse any third party services or content.
You need to be 18 years of age in order to access our services and platform. For you to use Instant Ride platform you would need to register an account on our platform. Your will be required to enter your personal information including but not limited to your name,surname, contact number,age and valid credit card details. Instant Ride reserves the right to suspend and/or terminate your account access and use of services due to misconduct or inaccurate information on your profile. You will be required to keep your login credentials in a safe place and not give them to any other person.
Our platform makes use of your mobile’s data connection, you are responsible for the use fees and rates associated with this type of connection. Instant Ride does not guarantee the platform will work on devices. Instant Ride shall not be responsible for malfunction of the platform resulting in damages to hardware or devices.
You agree that by using Instant Ride platform, you shall not:
4.1 Stalk or harass individuals
4.2 Violate any law
4.3 Use the Instant Ride platform in any way that infrignes any third party's rights
4.4 Adapt, translate, reverse engineer, decipher Instant Ride platform
4.5 Transfer or sell your user account or related details
4.6 iFrame any part or reverse engineer any part or thereof of the Instant Ride platform and website
4.7 Create liability for us or cause us to become subject to regulation as a transportation carrier or provider of taxi service
We reserve the right to terminate your user account should you contravene any of the above prohibited activites or any other terms contained here and elsewhere that pertains to the intellectual property of Instant Ride.
You agree as Rider that the use of the platform or service may result in charges for services of goods your receive from third parties (Charge’s) . Charges include Ride Fees and other applicable fees, tolls, surcharges, and taxes. Instant Ride has the authority and reserves the right to determine and modify pricing by posting applicable Charges to our platform or website. Charges paid by you are non-refundable and is left to Instant Ride discretion to issue such refunds.
All charges are due immediately and such payment will be facilitated by Instant Ride from your nominated credit card. Should the funds not be available or any other problems encountered to charge your credit card you agree that Instant Ride will use your secondary credit card information.
Due to high demands Instant Ride may charge higher rates , Instant Ride will take the reasonable steps to ensure you are aware of such rates. You may cancel services or good via the Instant Ride platform which may incur a cancellation charge which will be charge to your credit card.
Cancellation Fee. In the event that you cancel a ride request on the Instant Ride Platform more than 5 minutes after such request is made, make repeated or frequent cancellations, or fail to show up for your ride in a timely manner, you agree to pay a “Cancellation Fee”.
All Charges are facilitated through a third-party payment processing service (e.g. Braintree, a division of PayPal, Inc.). Instant Ride may replace its third-party payment processing services without notice to you. Charges shall only be made through the Instant Ride Platform.
By visiting the website and Instant Ride Platform of Instant Ride , viewing, accessing or otherwise using any of the services or information created, collected, compiled or submitted to Instant Ride , you agree to be bound by the following Terms and Conditions of Service. If you do not want to be bound by our Terms your only option is not to visit, view or otherwise use the services of Instant Ride .You understand, agree and acknowledge that these Terms constitute a legally binding mandate and agreement between you and Instant Ride and that your use of Instant Ride platform shall indicate your conclusive acceptance of this agreement.
By accessing this website and Instant Ride Platform, you are deemed to have read, understood and agreed to the terms. Instant Ride may at any time modify any of the terms and such modification will supersede and replace any previous terms. The amended terms will be made available on the website. Each time you access the website and Instant Ride Platform, you agree to be bound by the terms, as they have changed. Instant Ride and its affiliates provide information and material relating to Instant Ride on this website and Instant Ride Platform (hereinafter referred to as “Instant Ride” or “the site and Instant Ride Platform”).The information and material provided on the site is not, nor is it represented to be, intended for distribution to or use by any person or entity (corporate or otherwise) in any jurisdiction or country where such distribution or use would be contrary to the laws and/or regulations of those jurisdictions or countries or which would subject Instant Ride , its directors, employees or its affiliates to any registration or regulatory requirement whatsoever within such jurisdiction or country. Any action contravening this prohibition may result in criminal or civil legal liability.
Although efforts have been made to protect information, Instant Ride provides no guarantee, warranty or undertaking in connection with the security of this website and Instant Ride platform. Instant Ride will not be responsible for and disclaims any liability for any loss, damage, costs or expenses that could result from interception by third parties of any information made available via this website and instant Ride platform.
Save as set out in the terms, Instant Ride makes no warranties, representations, statements or guarantees (whether express, implied in law or residual) regarding the website and the service/s and the website and service/s made available via the website and platform are provided “as is”. The advertising of our services via the website merely constitutes an invitation by Instant Ride for you to download our application and view our services. Instant Ride reserves the right not to accept and/or comply with any application for any reason whatsoever on notice to you. Should Instant Ride accept your application for our platform, the agreement is governed by the terms and conditions, terms, legal disclaimer and the privacy policy of Instant Ride and this website.
Neither Instant Ride , nor any of its affiliates, directors, officers, employees, consultants, agents, shareholders nor any third-party vendor (in whose favour this constitutes a stipulation for the benefit of another) will be liable or have any responsibility of any kind for any loss or damage incurred in the event of any failure or interruption of the site and Instant Ride platform, or resulting from the act or omission of any other party involved in making the site Instant Ride platform or the data contained herein available, or from any other cause relating to access to, inability to access, or use of the site Instant Ride platform or the material, whether or not the circumstances giving rise to such cause may have been within the control of Instant Ride or of any vendor providing software or services support. By accessing this website Instant Ride platform, you warrant and represent to Instant Ride that you are legally entitled to do so. If you subscribe for any of our products you warrant and represent that you are legally authorised to subscribe for such services. You further warrant you will not use the website Instant Ride platform, the products and/or the services or any information made available or sent to you by us pursuant to your use of the website Instant Ride platform for any purpose that is unlawful or prohibited under South African law or is in contravention of the terms. You hereby indemnify Instant Ride against any loss, liability, damage or expense of whatever nature which Instant Ride or any third party may suffer which is caused by or attributable to, whether directly or indirectly, a breach by you of any of the warranties in these terms.
We may modify, withdraw or deny access to this website and Instant Ride platform at any time.
should any dispute, disagreement or claim arise between the parties concerning this Agreement ("the dispute"), the Parties shall endeavour to resolve the dispute by negotiation.
This entails one of the Parties inviting the other Party in writing for each of the CEO's to meet and to attempt to resolve the dispute within 10 (ten) days from date of written invitation.
lf the dispute has not been resolved by such negotiation within 10 (ten) days of the commencement thereof by agreement between the Parties, then the Parties shall refer the dispute to the Arbitration Foundation of Southern Africa ("AFSA") for final resolution by way of arbitration in accordance with the expedited rules of AFSA by an arbitrator or arbitrators appointed by the Registrar of AFSA for the time being.
Unless otherwise agreed in writing by the Parties, any such negotiation or arbitration shall be held in Durban, South Africa.
The provisions of this clause shall not preclude a Party from seeking urgent interim relief from the appropriate court of law.
The user to the jurisdiction of Durban Magistrates Court (Durban,South Africa) should any legal disputes arise which have not been resolved internally. These terms and conditions have been constructed and governed by laws of South Africa.

Nothing in this agreement, or in your use of the Website or the App, shall create between us a partnership, joint venture, employer-employee relationship, or franchisor-franchisee relationship. Our relationship shall be solely as independent contractors.
By becoming a User, you consent to receiving e-mail communications and text messages initiated by Instant Ride and through Instant Ride platform. Standard text messaging charges applied by your cell phone carrier will apply to text messages sent by Instant Ride. If you change your mobile phone service provider, the notification service may be deactivated for your phone number and you may need to re-enroll in the notification service. If you do not wish to receive any of our e-mail communications or text messages, please do not use the Services.
